General Terms and Conditions (GTC) of kinder&konsorten

§1 Applicability to entrepreneurs and definitions of terms
(1) The regular terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
(2) "Consumer" within the meaning of these terms and conditions is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their self-employed professional activity.

§2 Formation of a contract, storage of the text of the contract
(1) The following regulations on the conclusion of a contract apply to orders via our Internet shop http://www.kinderundkon sorten.de.
(2) If the contract is concluded, the contract comes with it

Condition.

(3) The presentation of the goods in our online shop does not represent a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) When an order is received in our online shop, the following regulations apply: The consumer makes a binding contract offer, according to which he successfully goes through the ordering procedure provided in our online shop.

The order is made in the following steps:
1) Selection of the desired goods
2) Confirm by clicking the "Add to cart" button
3) Click on the "Checkout" button
4) Checking the information in the shopping cart
5) Choice of payment method
6) Registration in the online shop with the billing and delivery address
7) Re-examination or correction of the entered data.
8) Pressing the "Buy" button
9) Binding dispatch of the order.

The consumer can. cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated email ("order confirmation"). With this we accept your offer.

(5) Storage of the contract text for orders via our online shop: We will send you the order data and our general terms and conditions by email. You can view the terms and conditions at any time at http://kinderundkonsorten.de/kinder-kon sorten/shop-regeln/agb/. For security reasons, your order data is no longer accessible via the Internet.


§3 Prices, shipping costs, payment, due date
(1) The prices indicated include the statutory sales tax and other price components. In addition, there are any shipping costs.
(2) The consumer has the option of paying by credit and debit card, Visa, AMex, Google Pay, Apple Pay, Shop Pay, Sofort(transfer) and PayPal.


§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for dispatch immediately.

§5 Retention of title
We reserve ownership of the goods until the purchase price has been paid in full.

§6 Right of return/ return policy
1. Free returns at our store in Dusseldorf, Germany.
2. If you are returning the goods by post, please send the goods back to the following address within 14 days:

The return is at the expense and risk of the customer.

All items must be returned undamaged and unused in the original packaging and with the original tags attached. Please ensure that the item you are returning is treated with care. We are not responsible for any damage incurred during return or your item lost during shipping.
We recommend using a postal service that will insure the value of your returned products or provide you with proof of postage. Lost packages will not be refunded and damaged items will not be accepted.

If kinder&konsorten has sent the wrong item or the goods arrive damaged, please report the damage to us immediately, unfortunately there is nothing we can do after 14 days of receipt of the goods.

Exceptions:
Gift cards, personalized items (e.g. name cushions), pacifiers and (skin-) care products cannot be returned or exchanged.

Liability for content:
The contents of our pages were created with great care. However, we cannot guarantee that the content is correct, complete or up-to-date. As a service provider, we are responsible for our own content on these pages according to Section 7, Paragraph 1 of the German Telemedia Act (TMG). The only contract language available is German.



General Terms and Conditions (GTC) of ReKind by kinder&konsorten

1. General
With ReKind, kinder&konsorten offers the opportunity to resell used children's clothing, shoes, and selected accessories within a secondhand concept.

By submitting items, customers agree to the following terms and conditions.


2. Acceptance of Items
Only freshly washed, complete, and well-preserved items for babies and children up to size 156 will be accepted.

kinder&konsorten reserves the right to refuse items depending on brand, condition, season, demand, or product focus.

kinder&konsorten categorizes items into the following categories:

  • gently worn
  • well loved
  • full of stories

Evaluation is based on condition, quality, and resale potential.


3. Preparation and Sale
All accepted items are carefully inspected and, if necessary, cleaned, prepared, or repaired.

Pricing is based primarily on:

  • the original selling price,
  • the condition of the item,
  • current demand, and
  • comparable market prices.

Items are initially offered at the regular price for 6 months and then sold at a reduced price for a further 3 months.

4. Commission / Store Credit
After a successful sale, customers receive a store credit of:

  • 25% for gently worn items
  • 20% for well loved items
  • 15% for full of stories items

The calculation is based on the actual selling price.

The store credit is credited to the customer's account after a successful sale. Notification is sent via email.

The store credit is valid for 6 months from the date it is credited and can be redeemed online and in-store. Cash payment is not possible.

5. Unsold Items
Unsold items can be picked up after the sale period has ended.

If no response or pickup occurs within 14 days of notification, kinder&konsorten is entitled to donate the items to Caritasverband Düsseldorf e.V. or other charitable organizations.

Retrieval of items during the sale period is generally possible. Any costs already incurred for cleaning, refurbishment, or repairs may be invoiced in this case.


6. Liability
All items are handled with the utmost care. However, kinder&konsorten assumes no liability for loss, damage, or soiling during storage, display, or fitting, except in cases of intent or gross negligence.


7. Exchanges and Returns
ReKind items are excluded from regular exchanges and returns. In exceptional cases, alternative arrangements may be made by individual agreement.
